Poland may take Hungary to EU court over asylum granted to ex-justice minister

Poland may take Hungary to the Court of Justice of the European Union over the granting of political asylum to former Polish Justice Minister Zbigniew Ziobro, Poland's current justice minister has said.

Justice Minister Waldemar Żurek said Warsaw first wants official confirmation that Hungary has granted asylum to Ziobro.

Ziobro, a senior figure in the former right-wing Law and Justice government, is the subject of criminal proceedings in Poland amid an investigation into the controversial Justice Fund.

One of Ziobro’s lawyers said on Monday that Hungary had granted him political asylum.

Hungary earlier granted asylum to Ziobro’s former deputy, Marcin Romanowski, who oversaw the Justice Fund under the previous government.

Speaking to reporters in Brussels on Wednesday, Żurek said granting asylum to an EU citizen implies that another EU member state is considered undemocratic.

"It so happens that Hungary has the biggest problems with the rule of law and is the closest ally in Europe of Vladimir Putin,” Żurek said, adding that Moscow was seeking to undermine Europe from within.

Żurek said the Polish government would "assess the matter from a legal standpoint" but had not yet received formal documentation confirming Ziobro’s asylum.

“We want to see the document,” he said. “We may have to take legal action and consider whether the Court of Justice of the EU should look into the matter.”

He warned that if EU countries begin granting asylum to one another’s citizens, it would undermine the bloc’s shared legal framework.

“If EU countries started to grant asylum to EU citizens, the common legal space will disappear,” Żurek said, adding that the European arrest warrant system would become "fiction."

A court in Warsaw on Thursday convened to consider a prosecutor’s request to place Ziobro in temporary detention.

If the court approves the request, prosecutors will be able to issue a wanted notice for Ziobro, Polish state news agency PAP reported.

If authorities determine that he is outside Poland, prosecutors could seek his arrest under a European arrest warrant, it said.
